Terms of Service

1. Who we are

PayKind ("PayKind", "we", "us") provides a hosted tip-link service that lets creators receive one-off and recurring payments from their supporters. By using the service you agree to these Terms.

2. Your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use PayKind. You are responsible for your account, your @handle, and anything you publish on your tip page. Keep your login credentials safe.

3. Payments and payouts

Payments on PayKind are processed by Stripe. To accept tips you must connect a Stripe Express account and accept Stripe's Connected Account Agreement and Stripe Services Agreement. Funds are paid out directly to your connected Stripe account on Stripe's payout schedule. PayKind does not hold your money.

You are responsible for the accuracy of the information you provide to Stripe, and for any taxes due on the income you receive through the service.

4. Acceptable use

You may not use PayKind to: (a) violate any law; (b) collect money for fraudulent, deceptive, or misleading purposes; (c) sell illegal goods or services; (d) infringe someone else's intellectual property; (e) harass, threaten, or harm others; (f) circumvent Stripe's restricted business list. We may suspend or terminate accounts that breach this section.

5. Content

You own the content you put on your tip page. You grant us a non-exclusive licence to host and display it so we can run the service. You are responsible for ensuring you have the rights to anything you publish.

6. Fees

PayKind is free to start. Stripe charges its own processing fees on each transaction — see stripe.com/pricing. If we introduce paid plans we will give you notice before they apply to your account.

7. Termination

You can delete your account at any time. We may suspend or close accounts that violate these Terms or that pose a risk to the service or to other users.

8. Disclaimers

The service is provided "as is" without warranty of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that any specific amount of tips will be received.

9. Limitation of liability

To the maximum extent permitted by law, PayKind will not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim (which, for free accounts, is zero).

10. Changes

We may update these Terms from time to time. If we make material changes we will notify you by email or in the app. Continued use of the service after changes means you accept the updated Terms.
